Understanding the Timeline of a Felony Case

Step 1: Arrest and Booking. This is often the initial interaction with law enforcement. You're taken into custody, fingerprinted, photographed, and your personal information is recorded. This can take several hours, and it's where you'll want to assert your right to remain silent and request an attorney.

Step 2: Arraignment. Within a few days of your arrest, you'll appear in court to be formally read the charges against you. You'll enter a plea (usually not guilty at this stage), and bail may be set. Your attorney will be crucial here to argue for reasonable bail or release on your own recognizance.

Step 3: Preliminary Hearing. For felony cases, this is a critical stage where a judge decides if there's enough evidence (probable cause) to send your case to trial. Your attorney can challenge the prosecution's evidence and call witnesses.

Step 4: Pre-Trial Motions and Negotiations. Between the preliminary hearing and trial, your lawyer will file motions, challenge evidence, and engage in plea bargain discussions with the prosecutor. This is where many cases are resolved without going to trial.

Step 5: Trial. If no agreement is reached, your case will go to trial. This involves jury selection, opening statements, presentation of evidence by both sides, closing arguments, and ultimately, a verdict. Trials can be lengthy and are prepared for meticulously.

Step 6: Sentencing (if convicted). If found guilty, the court will determine your penalties, which can range from probation to lengthy prison sentences, depending on the crime and your criminal history. Your attorney will advocate for the most lenient sentence possible.
